29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): (a) On or about January 11, 2021, and at times prior, the employer did not initiate and maintain regular and frequent inspections of equipment used on jobsites. As a result, employees were exposed to struck by and/or crushing hazards when the Moffett truck mounted forklift, model number 6170, serial number N480028, was not taken out of service when the rear tire for the fork truck was in need of replacement.

29 CFR 1910.178(l)(3)(ii)(A): The employer did not ensure that powered industrial truck operators received initial training on work-related topics to include surface conditions where the vehicle will be operated: (a) On or about January 11, 2021, and times prior to that date, the employer had not effectively trained an employee in the safe operations of the Moffett truck mounted forklift, model number 6170, serial number N480028, and how to identify and avoid the hazards associated with operating on or near slopes and inclines as well as surface conditions when at delivery job sites. Note: The requirements s applicable to construction work under 29 CFR 1926.602(d) are identical to those set forth at 29 CFR 1910.178(l).
