29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  New residential construction located on Lot #364 at 206 Randall Drive, Peachtree City, GA 30269, First level stairwell: On or about 01/19/2021, the employer exposed employees to fall hazards of approximately 10-feet, 3-inches to the lower concrete surface below, in that the ladder used to access the second level landing was not extended at least 3-feet or secured to prevent movement during use. The Franklin 17-ft (Model 63418) Aluminum Ladder was the only ladder provided to access the second level.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    New residential construction located on Lot #364 at 206 Randall Drive, Peachtree City, GA 30269, Second level top plates: On or about 01/19/2021, the employer exposed employees to fall hazards of 18-feet, 7-inches to the lower level, in that a fall protection system was not provided to an employee removing frost, ice from the top plates with a broom in preparation for new roof truss installation.   Bendicion Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number #1455457, citation number 1, item number 2 and was affirmed as a final order on 03/27/2020, with respect to a workplace located at Lot #324 at 102 Westberry Street, Peachtree City, GA 30269.
