29 CFR  1926.1053(b)(13):The top or step of a stepladder was used as a step:  (a) New residential construction, Lot 20, second floor: On or about 8/12/2021, and at times prior, the employer exposed his employee to fall hazards in that the employee was performing framing work on the second floor and was standing on the top cap of a 6-foot A-frame ladder to conduct framing work. The height was measured at 9 feet 10 inches from the ground level to the  eave of the second floor.

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:   a)  New residential construction, LOT 20, second floor:  On or about 8/12/2021, and at times prior, the employer exposed an employee to struck-by hazards, in that he was operating a Matebo NR83A5 strip nail gun at 110 PSI  while conducting framing activities without eye protection. The employee was framing the second floor.  Bendicion Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.102(a)(1), which was contained in OSHA inspection number 1454547, citation number 1, item number 1 and was affirmed as a final order on 3/27/2020, with respect to a workplace located at 102 Westbury St. Peachtree City GA. 30269. Lot 324

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) New residential construction, LOT 20, Second floor:  On or about 8/12/2021, and at times prior, the employer exposed employees to fall hazards of 9 feet 10 inches, in that a complete fall protection system was not provided to employees who were conducting framing activities on on the second floor of a new residential construction.   Bendicion Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1510502, citation number 2, item number 1 and was affirmed as a final order on 2/26/2021, with respect to a workplace located at 206 Randall Dr. Peachtree City GA. 30269 Lot 364.
