29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites: A.) John Corwin dba Corwin Construction, 4646 West 12th Street, Erie, PA 16505, on or about January 22, 2021 and times prior thereto: Employees were operating a Makita handheld circular saw (M/N: 5007MG, S/N: 0766088). The handheld circular saw was not being used in conjunction with GFCI or an assured equipment grounding conductor program. B.) John Corwin dba Corwin Construction, 4646 West 12th Street, Erie, PA 16505, on or about January 22, 2021 and times prior thereto: Employees of a sub-contractor were using a Ridgid Air Compressor (M/N: OF45175A). The air compressor was being used to operate a Button Kap RN78134 ButtonKap Nailer and Roofing Nailer for roofing activities. The air compressor was not being used in conjunction with GFCI or an assured equipment grounding conductor program. C.) John Corwin dba Corwin Construction, 4646 West 12th Street, Erie, PA 16505, on or about January 22, 2021 and times prior thereto: Employees were utilizing a Kensington K62667/S422B1 relocatable power tap to power battery chargers including, but not limited to, a Makita DC18RD Two Port Multi Charger, a Makita DC18RC T Fast Charger, and a Makita DC18SD Class 2 High Capacity Battery Charger. The relocatable power tap and the battery chargers were not being used in conjunction with GFCI or an assured equipment grounding conductor program. D.) John Corwin dba Corwin Construction, 4646 West 12th Street, Erie, PA 16505, on or about January 22, 2021 and times prior thereto: Employees of a sub-contractor were utilizing a Kensington K62667/S422B1 relocatable power tap to power battery chargers including, but not limited to, two Ryobi P117 Class 2 battery chargers. The relocatable power tap and the battery chargers were not being used in conjunction with GFCI or an assured equipment grounding conductor program. NO ABATEMENT CERTIFICATION OR DOCUMENATION REQUIRED

The flexible cord of the battery charger was spliced with a second cord and secured with electrical tape. The flexible cord of the battery charger was not in a continuous length. 29 CFR 1926.405(a)(2)(ii)(I): Protection was not provided to avoid damage to flexible cords and cables used for temporary wiring which passed through doorways or other pinch points: A.) John Corwin dba Corwin Construction, 4646 West 12th Street, Erie, PA 16505, on or about January 22, 2021 and times prior thereto: A blue flexible cord (extension cord) was running from an electrical outlet inside the building, through a hole in the front, exterior wall of the building, and to a Ridgid Air Compressor (M/N: OF45175A). An employee from a sub-contractor was using the air compressor in conjunction with a Button Kap RN78134 ButtonKap Nailer and Roofing Nailer for roofing activities. The flexible cord was not protected where it passed through the hole in the wall. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
