29 CFR 1926.21(b)(2):  The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:  A.)  Joe Miller dba Joe Miller Construction, 4646 West 12th Street, Erie, PA  16505, on or about January 22, 2021 and times prior thereto:  Employees were operating a Button Kap RN78134 ButtonKap Nailer and Roofing Nailer for roofing activities without safety glasses.  The employees did not have personal protective equipment training.  B.)  Joe Miller dba Joe Miller Construction, 4646 West 12th Street, Erie, PA  16505, on or about January 22, 2021 and times prior thereto:  Employees were exposed to electrical hazards including, but not limited to, a lack of GFCI/assured equipment grounding conductor program and running flexible cords through walls.  The employees did not have training on safe electrical work practices.  C.)  Joe Miller dba Joe Miller Construction, 4646 West 12th Street, Erie, PA  16505, on or about January 22, 2021 and times prior thereto:  Employees were operating a Button Kap RN78134 ButtonKap Nailer and Roofing Nailer for roofing activities.  The employees did not have training on the safe operations of, and hazards associated with, pneumatic nailers.  D.)  Joe Miller dba Joe Miller Construction, 4646 West 12th Street, Erie, PA  16505, on or about January 22, 2021 and times prior thereto:  Employees were provided with, and permitted to use, portable fire extinguishers.  The employees did not have fire extinguisher training.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

Joe Miller dba Joe Miller Construction, 4646 West 12th Street, Erie, PA  16505, on or about January 22, 2021 and times prior thereto:  Employees were using a Ridgid Air Compressor (M/N:  OF45175A).  The air compressor was being used to operate a Button Kap RN78134 ButtonKap Nailer and Roofing Nailer for roofing activities.  The air compressor was not being used in conjunction with GFCI or an assured equipment grounding conductor program.  B.)  Joe Miller dba Joe Miller Construction, 4646 West 12th Street, Erie, PA  16505, on or about January 22, 2021 and times prior thereto:  Employees were utilizing a Kensington K62667/S422B1 relocatable power tap to power battery chargers including, but not limited to, two Ryobi P117 Class 2 battery chargers.  The relocatable power tap and the battery chargers were not being used in conjunction with GFCI or an assured equipment grounding conductor program.  NO ABATEMENT CERTIFICATION OR DOCUMENATION REQUIRED

29 CFR  1926.405(a)(2)(ii)(I): Protection was not provided to avoid damage to flexible cords and cables used for temporary wiring which passed through doorways or other pinch points:  A.)  Joe Miller dba Joe Miller Construction, 4646 West 12th Street, Erie, PA  16505, on or about January 22, 2021 and times prior thereto:  A blue flexible cord (extension cord) was running from an electrical outlet inside the building, through a hole in the front, exterior wall of the building, and to a Ridgid Air Compressor (M/N:  OF45175A).  An employee was using the air compressor in conjunction with a Button Kap RN78134 ButtonKap Nailer and Roofing Nailer for roofing activities.  The flexible cord was not protected where it passed through the hole in the wall.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
