29 CFR 1926.453(b)(2)(v):A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering or in a restraint system is acceptable and is regulated under Sec. 1926.502(e). On or about January 21, 2021, two workers, who are employees of DBA FLRS Contracting, were performing installation work on the side of a steel structure under construction while working from inside an aerial lift owner by Truss Erection Services. The workers were positioned approximately 20 feet off the ground without wearing fall protection, exposing the workers to a fall hazard.
