On or about January 28, 2021, employees engaged in residential framing operations were exposed to struck-by hazards while operating pneumatic nail guns without eye protection. Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    On or about January 28, 2021, employees were exposed to fall hazards between 10 feet, 10 inches and 30 feet high while engaged in residential framing activities.  Fall protection was not being utilized while performing framing operations.     No abatement certification or documentation required for this item.

29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  On or about January 28, 2021, the employer failed to certify that employees had been trained to recognize and minimize fall hazards.  Employees were exposed to fall hazards between 10 feet, 10 inches and 30 feet high while performing framing activities on a residential structure without using fall protection.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).  Kobi Highlander, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(b)(1) which was contained in OSHA inspection number 1486698, citation 1, item 1, and was affirmed as a final order on December 29, 2020, with respect to a worksite located at 5521 Fairmount St., Burbank, IL.  Kobi Highlander, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(b)(1) which was contained in OSHA inspection number 1452011, citation 2, item 1, and was affirmed as a final order on March 3, 2020, with respect to a worksite located at 621 Walnut, Hinsdale, IL.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab rail, shall be provided to assist employees in mounting and dismounting the ladder.  In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  On or about January 28, 2021, at the above addressed jobsite, the A-frame portable ladders used to access the residential third level did not extend at least three (3') feet above the upper landing surface, thereby exposing employees to fall hazards of approximately 8 feet, 1 inch.    No abatement certification or documentation required for this item.  Kobi Highlander, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1) which was contained in OSHA inspection number 1462157, citation 1, item 4(a), and was affirmed as a final order on July 29, 2020, with respect to a worksite located at 3207 York Rd., Oak Brook, IL.
