General-duty citation text
29 CFR 1926.200(g)(2):1926.200(g)(2) The design and use of all traffic devices, including signs, signals, markings, barricades, and other devices, for protection of construction workers did not conform to Part 6 of the MUTCD (incorporated by reference, see 1926.6): Location: Mountain Road near Guilford Road, Lempster NH On or about 1/26/2021, employees working in the West bound lane effectively closing the lane and requiring the use of a single lane by traffic approaching from both directions, were not protected from being struck by vehicular traffic where traffic control devices were not in use to coordinate traffic. Reference Part VI of the Manual of Uniform Traffic Control Devices, section 6C.10 that requires traffic to be coordinated on each end of the worksite when one-lane is utilized for traffic approaching in both directions. The self-regulating exception to the standard cannot be applied because Mountain Road is not a low volume road according to NH DOT and approaching traffic could not see in both directions due to road design.
