29 CFR 1910.1025(d)(2):Initial determination. Each employer who has a workplace or work operation covered by this standard shall determine if any employee may be exposed to lead at or above the action level (Maritime Reference 1915.1025): a) On or about January 26, 2021, the employer had not conducted initial lead exposure monitoring for employees conducting shipbreaking operations of the 104 year old ship William H. Donner. Employees were torch cutting the ship steel from an aerial lift and on the ground.

29 CFR 1910.1025(j)(3)(i)(B): Medical examinations and consultations - Frequency. The employer shall make available medical examinations and consultations to each employee covered under paragraph (j)(1)(I) of this section on the following schedule: Prior to assignment for each employee being assigned for the first time to an area in which airborne concentrations of lead are at or above the action level (Maritime Reference 1915.1025): a) On January 28, 2021, the employer had not made available the medical examination and consultation to a Torch Cutter exposed to an 8 hour Time Weighted Average Lead exposure of 0.05mg/M3. The lead action level is 0.03 mg/M3. The Torch Cutter had been working at the job site over 1.5 months.
