29 CFR  1915.152(a):Provision and use of equipment. The employer shall provide and shall ensure that each affected employee uses the appropriate personal protective equipment (PPE) for the eyes, face, head, extremities, torso, and respiratory system, including protective clothing, protective shields, protective barriers, personal fall protection equipment, and life saving equipment, meeting the applicable provisions of this subpart, wherever employees are exposed to work activity hazards that require the use of PPE.  On or about February 18, 2021, employees were  exposed to fall hazards of approximately 10 feet or greater while working near an unguarded deck edge during the dismantling of the William H. Donner and were not utilizing personal fall arrest systems that had been designated for use by the employer.

29 CFR  1915.503(a)(2)(ii):The employer shall authorize employees to perform hot work only in areas that are free of fire hazards, or that have been controlled by physical isolation, fire watches, or other positive means.   Employees of RJ Industrial were exposed to potential fire hazards when the a large collection of coal was not removed from a ship compartment prior to the section being cut apart by acetylene torches    Note to paragraph (a)(2): The requirements of paragraph (a)(2) apply to all hot work operations in shipyard employment except those covered by �� 1915.14.

29 CFR  1915.112(c)(1)(i): Employers must ensure that chain and chain slings have permanently affixed and legible identification markings as prescribed by the manufacturer that indicate the recommended safe working load for the type(s) of hitch(es) used, the angle upon which it is based, and the number of legs if more than one.  On or about January 28, 2021, the three-legged chain sling the employer was utilizing to attach a magnet to CAT 336E Excavator did not have an identification tag or markings to indicate the safe working load, angle and correct number of legs for the sling.
