29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person: (a) On or about February 2, 2021, the employer, RM Construction, LLC., exposed employees to fall hazards in that the scaffold being used to conduct fascia work was not designed by a qualified person. The scaffold was tipping/rocking from side to side while the employees were walking from one end of the scaffold to the other. The scaffold was hoisted 23.4 feet in height to the area of the residential home located at 101 South Ridge Road in Castle Rock, CO. The employees were being hoisted by a CAT TH560B forklift.

29 CFR 1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied. (a) On or about February 2, 2021, the employer, RM Construction, LLC., did not ensure exposed employees were protected from fall hazards, at the height of 23.4 feet. The platform used as a scaffold was not securely affixed to the forks of the forklift Model CAT TH560B while conducting fascia work of a residential home. The residential home was located at 101 South Ridge Road, Castle Rock, CO.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: (a) On or about February 2, 2021, the employer, RM Construction, LLC, did not ensure exposed employees were protected from fall hazards of 23.4 feet in height from unprotected sides and ends of the scaffold platform. The employer did not ensure exposed employees were protected by the use of a fall protection system at the residential home located at 101 South Ridge Road, Castle Rock, CO.
