29 CFR 1926.20(b)(2): The employer did not initiate and maintain an accident prevention program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them.): (a)Paul Fick Homes, Inc. at 412 North Willow Creek Avenue, Sioux Falls, SD 57110: On or about and at times prior to February 9, 2021, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees were exposed to fall hazards of approximately 10 feet installing wood trusses while working from the exterior top plates and using the top step of A-frame ladders to access the trusses. The condition exposed employees to a fall hazard greater than 10 feet. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. Paul Fick Homes, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1186998, citation number 1, item number 1 and was affirmed as a final order on February 10, 2017, with respect to a workplace located at 6500 East Steamboat Trail, Sioux Falls, SD 57107.
