29 CFR  1910.95(j)(2):Hearing protectors did not attenuate employee exposure at least to an 8-hour time-weighted average of 90 decibels as required by 29 CFR 1910.95(b):  a) 1100 Lincoln Road, Birdsboro, PA 19508 -   An employee in the Evisceration Room was exposed to 103 dba Time Weighted Average over an 8 hour workday.  The employer did not ensure that issued hearing protection was rated to reduce employee exposure below 90 decibels as required by the standard, on or about April 8, 2021.    b)   1100 Lincoln Road, Birdsboro, PA 19508 -  An employee in the Pick Room was exposed to 105.7 dba Time Weighted Average over an 8 hour workday.  The employer did not ensure that issued hearing protection was rated to reduce employee exposure below 90 decibels as required by the standard, on or about April 8, 2021.    c)  1100 Lincoln Road, Birdsboro, PA 19508 - An employee in the Kill Room was exposed to 105 dba Time Weighted Average over an 8 hour workday.  The employer did not ensure that issued hearing protection was rated to reduce employee exposure below 90 decibels as required by the standard, on or about April 8, 2021.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

The employer did not ensure that feasible administrative or engineering controls were utilized to reduce noise levels, on or about April 8, 2021.    b)  1100 Lincoln Road, Birdsboro, PA 19508 - An employee in the Pick Room was exposed to 105.7 dba Time Weighted Average over an 8 hour workday.   The employer did not ensure that feasible administrative or engineering controls were utilized to reduce noise levels, on or about April 8, 2021.    c) 1100 Lincoln Road, Birdsboro, PA 19508 -  An employee in the Kill Room was exposed to 105 dba Time Weighted Average over an 8 hour workday.  The employer did not ensure that feasible administrative or engineering controls were utilized to reduce noise levels, on or about April 8, 2021.      Birdsboro Kosher Farms was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1910.95(b)(1), which was contained in OSHA inspection number 1131470, citation number 2, item number 4 and was affirmed as a final order on December 1, 2020, with respect to a workplace located at 1100 Lincoln Road, Birdsboro, PA 19508.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
