29 CFR  1910.147(c)(6)(ii):The employer did not certify that the periodic inspections have been performed:  a) BIRDSBORO KOSHER FARMS FACILITY - The employer did not ensure that equipment including but not limited to; the Risco stuffer (grinding room), Grinder D225A (Second processing room) and HiTec Linkwell machine (RTE raw) did not have the required periodic inspection certification for the calendar year 2020, exposing employees to caught in, struck by and electrical hazards, on or about February 10, 2021.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written record

29 CFR  1910.147(c)(7)(i)(B): Affected employees were not instructed in the purpose and use of the energy control procedure:   a) BIRDSBORO KOSHER FARMS FACILITY -  Affected employees who conduct work in spaces where  authorized personnel perform service and maintenance operations on production equipment including but not limited; to the Risco stuffer (grinding room), Grinder D225A (Second processing room) and HiTec Linkwell machine (RTE raw) have not been instructed by the employer of the purpose of why energy control procedures are vital to the safety of those who work in the area of the machines and the potential dangers for the calendar year 2020, thereby exposing employees to serious injury, on or about February 10, 2021.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR  1910.305(g)(1)(iv)(A): Flexible cords and/or cables were used as a substitute for the fixed wiring of a structure:   (a) Break room - A relocatable power tap was used as a substitute for fixed wiring,  providing power to a microwave, refrigerator and soda vending machine, creating a  fire hazard in the event of amperage overloading,  on or about February 10, 2021.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1910.147(c)(6)(i):The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  a) BIRDSBORO KOSHER FARMS FACILITY - The employer did not conduct periodic inspections of the lock out tag out procedures on production equipment including but not limited to the Risco stuffer (grinding room), Grinder D225A (Second processing room) and HiTec Linkwell machine (RTE raw) exposing employees to hazards related to the unexpected start up or release of stored energy, on or about February 10, 2021.  Birdsboro Kosher Farms Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.147(c)(6)(i), which was contained in OSHA inspection number 1132233, citation number 1, item number 1 C and was affirmed as a final order on December 1, 2020 with respect to a workplace located at 1100 Lincoln Road, Birdsboro, PA 19508  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
