29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: a) Building 3 interior, east side, adjacent to overhead drive through door: A JLG I 930EX scissor lift being operated by an employee was struck by the a garage bay door causing the employee in the lift to fall out of the lift to the ground below. The employer did not ensure that precautions were taken such as, but not limited to, locking or otherwise securing the garage bay door so that it would not open and strike the aerial lift platform. Occurred on or about 2/15/2021 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.200(g)(1):Construction areas were not posted with legible traffic signs at points of hazards: a) a) Building/Section 3 overhead door, east side of building: The employer did not ensure that signs or other control devices were posted to prevent forklift traffic from entering the area where the construction work was occurring. An employee installing electrical equipment from a scissor lift was ejected from the lift and fatally injured when a forklift entered the construction area and activated an overhead door, which struck the scissor lift and knocked it over. Observed on or about 2/15/2021.

29 CFR 1926.454(a):The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: a) 45 Mill Street, Mays Landing, NJ manufacturing site: The employer did not adequately train an employee in the recognition and avoidance of unsafe conditions such but not limited to working in close proximity of a door opening and the potential need to secure the overhead doors or lock out the controls to prevent the opening and closing of the overhead doors in close proximity. Observed on or about 2/15/2021 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
