29 CFR  OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while climbing the rails of a man basket exposing the employee to a fall hazard of 15 feet 11 inches to the ground below:     a)  At 2186 Ponce De Leon Court, Fort Morgan, Alabama:  On or about November 13, 2020, and at times prior; the employer allowed his employees to exit the first floor window opening of a residential structure and climb out onto the outside rails of a man basket to perform house wrapping activities exposing the employee to a fall hazard of 15 feet 11 inches to the ground below.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:   a)  At 2186 Ponce De Leon Court, Fort Morgan, Alabama:  On or about November 13, 2020, and at times prior; the employer allowed his employee to perform framing activities without first ensuring his employee was trained on the hazards associated with falls to include but not limited to setting up and inspecting fall protection exposing the employee to a fall hazard of 15 feet 11 inches to the ground below.

29 CFR  1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):     a)  At 2186 Ponce De Leon Court, Fort Morgan, Alabama:  On or about November 13, 2020, and at times prior; the employer exposed employees to struck-by hazards in that the employer permitted an employee to operate a Powered Industrial Truck (Telehandler) without first ensuring the employee was trained and certified to operate the equipment.

29 CFR  1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:   a)  At 2186 Ponce De Leon Court, Fort Morgan, Alabama:  On or about November 13, 2020, and at times prior; the employer allowed his employees to climb through an unguarded wall opening on the first level of  house to gain access to the man basket to perform house wrapping activities exposing the employee to a fall hazard of 15 feet 11 inches to the ground below.  The S & J Corona Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926. 501(b)(13) which was contained in OSHA inspection number 1421089, citation number 1, item  1 and was affirmed as a final order on September 3, 2019, with respect to a workplace located at 26051 Cotton Bayou Dr., Orange Beach, Alabama.  The S & J Corona Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926. 501(b)(13) which was contained in OSHA inspection number 1191056, citation number 1, item  1 and was affirmed as a final order on December 23, 2016, with respect to a workplace located at 3097 West Beach Blvd., Gulf Shores, Alabama.

29 CFR  1904.39(a)(2): The employer did not report the in-patient hospitalization of one or more employees to OSHA within twenty-four (24) hours:   a)  At 2186 Ponce De Leon Court, Fort Morgan, Alabama:  The employer failed to report a work-related  in-patient hospitalization of an employee that occurred on November 13, 2020 within 24 hours to OSHA as required by the standard.
