29 CFR  1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:   (a) Diamond Spas, Inc., 4409 Coriolis Way, Frederick, CO 80504: On or preceding February 23, 2021, the employer did not evaluate the employee exposure to copper fume. Employees welded copper. The process generated copper fume.  This condition exposes employees to respiratory hazards associated with copper fume.  (b) Diamond Spas, Inc., 4409 Coriolis Way, Frederick, CO 80504: On or preceding February 23, 2021, the employer did not evaluate the employee exposure to methyl methacrylate vapor. Employees applied an epoxy containing methyl methacrylate to spas. The process generated methyl methacrylate vapor.  This condition exposes employees to respiratory hazards associated with methyl methacrylate vapor.

29 CFR  1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:   (a) Diamond Spas, Inc., 4409 Coriolis Way, Frederick, CO 80504: On or preceding February 23, 2021, the employer did not ensure that employees that were required to wear tight fitting air purifying half mask respirators were fit tested prior to doing so. Employees were required to wear such respirators when welding.  This condition exposed employees to a respiratory hazard.  (b) Diamond Spas, Inc., 4409 Coriolis Way, Frederick, CO 80504: On or preceding February 23, 2021, the employer did not ensure that employees that were required to wear an N95 filtering face piece respirator were fit tested prior to doing so. Employees were required to wear such respirators when welding.  This condition exposed employees to a respiratory hazard.

29 CFR  1910.252(a)(1)(i):When the object to be welded or cut could not be readily moved, all movable fire hazards in the vicinity were not taken to a safe place:  (a) Diamond Spas, Inc., 4409 Coriolis Way, Frederick, CO 80504: On or preceding February 23, 2021, the employer did not ensure that movable fire hazards were moved from an area where welding was taking place.  Flammable adhesive  and primer were stored above a welding station within approximately 12 feet. This condition exposed employees to a fire hazard.

Employees used chemicals for spa manufacturing operations. Chemicals in the workplace included, but were not limited, to the following:  1.  Copper; 2.  Stainless Steel;  3.  ASI MP-55320-A; 4.  Argon; and 5.  Tungsten.

The employer did not train employees on the elements of this standard. The employer did not train employees on the written hazard communication program, or how to locate safety data sheets. Employees use chemicals for spa manufacturing operations.   Chemicals in the workplace included, but were not limited, to the following:  1.  Copper; 2.  Stainless Steel;  3.  ASI MP-55320-A; 4.  Argon; and 5.  Tungsten.
