29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) All American Stair Company, Inc., at 5000 Oakland St, Denver, CO 80239: On and before January 11, 2021, the employer did not administer a continuing, effective hearing conservation program. Employees worked in the shop with power tools and woodworking equipment, including but not limited to saws, nail guns, and staple guns. Employee exposure to noise was in excess of the OSHA Action Level for noise. A hearing conservation program was not effectively implemented. This condition exposed employees to noise hazards.
