29 CFR 1910.120(q)(2): The employer did not develop an emergency response plan for emergencies which addressed the following minimum requirements of this standard: 1910.120(q)(2)(i) through 1910.120(q)(2)(xii): A) Estes Express Lines, on or about February 19, 2021 at the address of 64 Stefanak Drive, New Castle, PA: An emergency response plan was not implemented to handle a chromic acid spill in the facility. Employees conducted emergency response operations which involved defensive actions including deploying quick-dry to contain the spill and maneuvered the 55 gallon drum to an up-right position.

29 CFR 1910.138(a):The employer did not select and require employee(s) to use appropriate hand protection when employees' hands were exposed to hazards such as those from skin absorption of harmful substances and chemical burns: A) Estes Express Lines, on or about February 19, 2021 at the address of 64 Stefanak Drive, New Castle, PA: employees did not wear any chemical resistant hand protection, while employees conducted emergency response cleanup of chromic acid. The employee tipped up a 55 gallon drum that contained chromic acid that had just been spilled without the benefit of chemical resistant hand protection.
