29 CFR 1910.134(d)(1)(ii):The employer did not select and use a NIOSH-certified respirator in compliance with the conditions of its certification: a) Southeast VA Clinic located at 3285 S Val Vista Dr, Gilbert, AZ 85295: On or about December 28 2020, the employer did not ensure that NIOSH-certified respirators were used in accordance with the conditions of the certification, where employees re-used N95 respirators for up to five work days consecutively while providing patient care. The employer required the employee[s] to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to patients.
