OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by or crushing hazard when operating forklifts without the use of a restraint device: a) Parts Area behind shop: On March 3, 2021 and at times prior thereto employees operated the KD Manitou powered industrial truck (forklift) without a seatbelt. Note) Abatement certification AND supporting documentation are required for this item.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a) Jobsite: On or about March 3, 2021 and at times prior thereto, employees to operated powered industrial trucks, including, but not limited to, a K-D Manitou Forklift. The company failed to provide powered industrial truck training that included a combination of formal instruction, practical training, and a performance evaluation. Abatement Note) The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. Note) Certification AND supporting documentation of corrective action are required for this item.
