29 CFR  1926.20(b)(1):The employer did not initiate and maintain such programs as may be necessary to comply with this part.  a) EMJ Construction LLC, on or about March 3rd, 2021, at the location of Homesite 62, Nash Ln, North Ridgeville, OH, 44039: Employees were performing framing activities on a new residential structure while exposed to fall hazards of approximately 21 feet without fall protection, and exposed to eye struck by hazards while using a pneumatic nailer without eye protection.  The employees did not have the benefit of an accident prevention program to identify and mitigate these hazards.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   a) EMJ Construction LLC, on or about March 3rd, 2021, at the location of Homesite 62, Nash Ln, North Ridgeville, OH, 44039: Employees were performing framing activities on a new residential structure while exposed to fall hazards of approximately 21 feet  without the benefit of fall protection training to enable them to identify and mitigate these hazards.
