29 CFR 1910.22(c):29 CFR 1910.22(c): The employer did not provide, and ensure each employee uses, a safe means of access and egress to and from walking-working surfaces: (a) BUILDING 41B, SMELTING DEPARTMENT - Employees attending the smelter kettles were exposed to fall hazards and soft tissue injuries when accessing the kettle hoods using the 24 inch high step on the side of the kettle hoods to access the kettle hood platforms, on or about March 6, 2021. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.28(b)(3)(i):29 CFR 1910.28(b)(3)(i): The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D): (a) BUILDING 41B, SMELTING DEPARTMENT - Employees attending the smelter kettles were exposed to fall hazards into the 6.25 foot deep smelter kettles when they performed tasks that included but were not limited to returning lead to the kettle through the access hole in the kettle hood, on or about March 6, 2021. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
