29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. a) For employees working at the location as observed on or about 3 March, 2021. Employees were accessing the upper working level by a single ladder that did not have the side rails extended at least 3 feet above the upper landing surface and the grasping device in use was a 5/8 inch piece of rebar that was approximately 36 inches in height. The grasping device was not sufficient in strength to prevent the employees from a fall.

29 CFR 1926.1060(a): The employer shall provide a training program for each employee using ladders and stairways, as necessary. The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards. a) For employees working at the location as observed on or about 3 March, 2021. Employees were accessing the upper working level by a single ladder that did not have the side rails extended at least 3 feet above the upper landing surface and the grasping device in use was a 5/8 inch piece of rebar that was approximately 36 inches in height. The grasping device was not sufficient in strength to prevent the employees from a fall. The employer failed to provide proof of required training.
