29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about March 3, 2021, and at times prior thereto, an employee was exposed to a fall hazard, while operating a Genie S-85 Telescopic Boom Lift without being trained on its safe operation and fall hazard recognition. b) On or about March 3, 2021, and at times prior thereto, an employee was exposed to a fall hazard, while operating a JLG Scissor Lift without being trained on its safe operation and fall hazard recognition.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: On or about March 3, 2021, and at times prior thereto, an employee without fall protection was exposed to a fall hazard while standing on the guardrails of an elevated JLG Scissor Lift to gain access to an upper steel structure.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On or about March 3, 2021, and at times prior thereto, employees were exposed to a fall hazard while operating a Genie S-85 Telescopic Boom Lift to access the top of the commercial construction without the fall protection system attached to the basket.
