29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)Jose Martinez at 4508 West 34th Street North, Sioux Falls, SD 57107:  On or about and at times prior to January 19, 2021, the employer did not ensure that employees were protected from fall hazards greater than six feet.  Employees were installing roofing materials on a single-family home with no fall protection in place.  This condition exposed employees to fall hazards greater than 8 feet.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:  (a)Jose Martinez at 4508 West 34th Street North, Sioux Falls, SD 57107:  On or about and at times prior to January 19, 2021, the employer did not ensure that fall protection training conducted for employees was documented by a written certification of record. Employees were working on the roof of a single-family home engaged in roofing activities without the use of a fall protection system. The condition exposed employees to a fall hazard of approximately 8 feet.   Abatement Note: The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.
