29 CFR 1926.451(g)(1):Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: Location - 15 Middle Street, Portsmouth, NH On or about March 11, 2021, when employees were working from and using a scaffold to access the roof of a three story building at 03801 without end rails and were exposed to fall hazards of 35 feet above the ground.

29 CFR 1926.501(b)(11):Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: Location - 15 Middle Street, Portsmouth, NH On or about March 11, 2021, employees were installing new roofing materials on the roof of a three story building without fall protections. The roof pitch was 9:12 and they were exposed to fall hazards of 35 feet up to 45 feet above the ground. Jose M Acero Chuma dba JMC construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1457975, citation number 1, item number 2 and was affirmed as a final order on2/18/2020, with respect to a workplace located at 318 Lexington Street, Woburn MA .
