29 CFR  1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:  The employer is failing to protect employees from cave-in hazards while performing boring activities in Type B soil. This was most recently observed at 6990 N 172nd Street Bennington, NE 68007 on March 10, 2021 where the employer had his employee in a trench that was approximately 6 feet deep while conducting boring operations at a residential home, and did not implement adequate protective systems to protect the employee from a cave-in.
