Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a. Located at 785 Huebury Drive in Pickerington, Ohio: On or about March 15, 2021, the employer did not ensure that employees performing roofing work from the second story roof were protected from an approximately twenty foot fall hazard.

29 CFR  1926.502(d):"Personal fall arrest systems." Personal fall arrest systems and their use shall comply with the provisions set forth below. Effective January 1, 1998, body belts are not acceptable as part of a personal fall arrest system. Note: The use of a body belt in a positioning device system is acceptable and is regulated under paragraph (e) of this section.  a. Located at 785 Huebury Drive in Pickerington, Ohio: On or about March 15, 2021, employees were performing roofing work while attached at the waist to climbing harnesses. The climbing harnesses were not approved for use as personal fall protection, thereby exposing employees to a fall hazard from approximately twenty foot.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. Located at 785 Huebury Drive in Pickerington, Ohio: On or about March 15, 2021, employees were using an aluminum extension ladder to access the first story roof that only extended approximately one foot above the roof eave. The condition of the ladder did not provide a safe means for employees to access or egress from the ladder, thereby exposing employees to a fall hazard.   b. Located at 785 Huebury Drive in Pickerington, Ohio: On or about March 15, 2021, employees were using an aluminum multi-use ladder to access the second story roof that only extended approximately one foot above the roof eave. The condition of the ladder did not provide a safe means for employees to access or egress from the ladder, thereby exposing employees to a fall hazard.
