29 CFR  1910.22(a)(3): 29 CFR 1910.22(a)(3): The employer did not ensure that walking-working surfaces are maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice.   On or about March 9, 2021, the employer failed to ensure that the walking working surfaces in the plant were clean, dry and free of debris. The plant has standing murky water and sludge of approximately 3+ inches throughout. Employees are exposed a potential slip, trip and fall hazard.

29 CFR  1910.28(b)(1)(i):(1) Unprotected sides and edges.  (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling:    On or about March 9, 2021, the employer did not ensure that employees were protected from a fall from height of greater than 4 feet down into the sloped pit at the loading dock area. Dock chains were down and the employer did not implement equivalent conventional or personal fall protection systems to address fall hazard. Employees worked and walked up to the unprotected edge of the pit and used a portable industrial stair/ladder to get into and out of the pit at various times during the day.

29 CFR  1910.28(b)(6)(i):29 CFR 1910.28(b)(6)(i): The employer did not ensure that each employee less than 4 feet (1.2 m) above dangerous equipment is protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment is covered or guarded to eliminate the hazard.  On or about March 9, 2021, the employer failed to protect employees from a fall into dangerous equipment. Employees were working from a platform on the FIS Line 1, that had the top rail removed and below them was a mechanized auger that was unguarded. Employees leaned over mid rail to reach across the auger below to pull pieces of material off the fixed grate. Employees exposed to falling into the unguarded rotating auger shaft.  On or about March 9, 2021, the employer failed to protect employees from a fall into dangerous equipment. Employees were working from a platform on the FIS Line 2, and below them was a mechanized auger that was unguarded. Employees are reaching over the top rail and in-between the top and mid rail opening in order to reach across the auger below to pull pieces of material off the above fixed grate. Employees exposed to falling into the unguarded rotating auger shaft.

29 CFR  1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.   On or about March 9, 2021, the employees that worked at FIS Line 1 and 2 were exposed to ingoing nip point and caught-in hazards created by the unguarded rotating auger. Employees leaned over the rotating auger in order to pull pieces of material off the above fixed grate.
