29 CFR 1926.451(b)(1): Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform and the uprights.  a) Worksite, 7931 60th Lane, Glendale, New York 11385:  On or about March 17, 2021, employees were performing vinyl siding installation work from a four-tier fabricated frame scaffold approximately 20-feet above the ground. The platform the employees were working from was not fully planked.   Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:  a) Worksite, 7931 60th Lane, Glendale, New York 11385:  On or about March 17, 2021, employees were accessing the fourth tier of the fabricated frame scaffold approximately 20-feet above the ground by climbing on the end frames and cross bracing.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification of documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1926.451(g)(4)(i):Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:  a) Worksite, 7931 60th Lane, Glendale, New York 11385:  On or about March 17, 2021, employees were performing vinyl siding installation work from a fabricated frame scaffold approximately 20-feet above the ground and did not have a guardrail system installed along all open sides and ends of the scaffold.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.1053(b)(4):Ladder(s) were used for purposes other than the purpose for which they were designed:  a) Worksite, 7931 60th Lane, Glendale, New York 11385:  On or about March 17, 2021, employees were working from an aluminum extension ladder set up perpendicular of the residential building  on the porch overhang approximately 20-feet above the ground with a wood plank  placed between the rung of the ladder and the platform of the fabricated frame scaffold.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
