29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  Avarice Construction, Inc. 29 CFR  1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  1650 Ivy Ct. E, Wheaton, IL 60189 - on or about March 17, 2021, the employer failed to adequately retrain roofers working at heights to know the trigger height for use of fall protection, and how to inspect elements of the personal fall protection system to identify damages for replacement. Employees re-roofing a residential house were exposed to fall hazards up to 25 feet because fall prevention/protection systems were not used to ensure safety.  The abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   1650 Ivy Ct. E, Wheaton, IL 60189 - on or about March 17, 2021, employees re-roofing a residential house were exposed to fall hazards up to 25 feet because fall prevention/protection systems were not provided and used.  The abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).  The Avarice Construction, Inc. doing business as Wheaton Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 1359243, citation number 01, item number 01 and was affirmed as a final order on February 15, 2019, with respect to a workplace located at 1590 President St., Wheaton, IL 60187.
