29 CFR 1910.134(a)(2): A respirator was not provided by the employer to each employee when such equipment was necessary to protect the health of the employee: On or about 2/13/21, and times thereafter, employees engaged in prisoner medical transportation in close contact as defined by the Centers for Disease Control and Prevention were only provided surgical masks for protection against aerosolized SARS-CoV-2 virus.

29 CFR 1960.8(a): The Agency head did not furnish employment and a place of employment to each employee that were free from recognized hazards that caused or were likely to cause death or serious physical harm in that unvaccinated employees continued work after close contact with people infected SARS-CoV-2, the virus that causes COVID-19: Throughout the facility. On or about 2/13/21 and continuing thereafter, employees worked in close contact and for more than 15 minutes with inmates that tested positive for COVID-19 while only wearing face coverings and were not required to quarantine or be tested for COVID-19.
