29 CFR 1910.107(d)(2): Spraying areas were not provided with adequate mechanical ventilation to remove flammable vapors, mists, or powders to a safe location and to confine and control combustible residues so that life was not endangered. Mechanical ventilation was not kept in operation at all times while spraying operations were being conducted and for a sufficient time thereafter to allow vapors from drying coated articles and drying finishing material residue to be exhausted: On or about March 23, 2021, three employees were spraying flammable industrial coatings on large metal vessels and tanks inside an open-room paint building without the use of mechanical ventilation, exposing employees to the hazard of fire.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: On or about March 23, 2021, three employees were using half face and full face respirators to conduct sanding and paint spraying operations inside the paint building, exposing the employees to the hazard of increased physiological burden and exacerbation of a cardiac or pulmonary disorder.

29 CFR 1910.134(f)(1): The employer shall ensure that employees using a tight-fitting facepiece respirator pass an appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT) as stated in this paragraph. On or about March 23, 2021, three employees were using tight fitting full face respirators to spray industrial paint coatings and work with other chemicals without being fit tested, exposing the employees to the hazard of inhaling hazardous chemicals.
