29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a. On or about March 25, 2021, and at times prior thereto, an employee was exposed to a fall hazard greater than six feet when installing a leading edge for a commercial construction site without fall hazard recognition.  b. On or about March 25, 2021, and at times prior thereto, an employee was exposed to a fall hazard greater than six feet when working in a basket of a JLG S460SJ telescopic boom lift without fall hazard recognition.

29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.  On or about March 25, 2021, an employee was exposed to a fall hazard to the ground level below while in a basket of a JLG S460SJ telescopic boom lift without being secured to the basket with a fall protection system.

29 CFR  1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:  Eastside of the fourth level.  On or about March 25, 2021, employees were exposed to a fall hazard greater than six feet to the ground level below while installing AAC panels on the fourth floor without using fall protection.
