29 CFR 1926.20(b)(2): The employer did not initiate and maintain an accident prevention program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)J&P Roofing Systems, Inc. at 1815 6th Street, Brookings, SD 57006: On or about and at times prior to March 26, 2021, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were exposed to fall hazards related to conducting roofing operations on a flat roof measuring 15 feet in height. This condition exposed employees to fall hazards of approximately 15 feet. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(10): Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted: (a)J&P Roofing Systems, Inc. at 1815 6th Street, Brookings, SD 57006: On or about and at times prior to March 26, 2021, the exposing employer did not ensure employees were protected from fall hazards while working on the roof of a commercial building under construction. Employees were conducting roofing work on curbs and parapet walls without a fall protection system. This condition exposed employees to a fall hazard of approximately 15 feet.

29 CFR 1926.501(b)(4)(ii):Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes by covers: (a)J&P Roofing Systems, Inc. at 1815 6th Street, Brookings, SD 57006: On or about and at times prior to March 26, 2021, the exposing employer did not ensure employees were protected from falls through holes on the walking/working surface. Employees were exposed to fall hazards associated with a hole approximately 40 inches wide by 60 inches long in the roof associated with a roof penetration for an HVAC system. This condition exposed employees to a fall hazard of approximately 15 feet to the interior of the building.
