29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about March 24, 2021, and at times prior thereto, employees engaged in applying roofing materials were not provided fall protection exposing employees to an unprotected fall hazard of approximately 12 feet to the ground below.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  On or about March 24, 2021, and at times prior thereto,  the employer did not ensure employees safely used the ladder to gain access to the residential roof.  The ladder was not secured at the top and did not extend three feet above the landing surface. Employees were exposed to a fall hazard of approximately 12 feet.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   On or about March 24, 2021, and at times prior thereto, employees engaged in applying roofing materials were not provided fall protection and the employer did not provide a training program to ensure the employees understood how to minimize fall hazards.

29 CFR  1926.503(c): The employer did not retrain affected employees  who already had been trained but demonstrated inadequate  understanding and skill required by paragraph (a) of this section: Note:  Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2) Changes in the types of fall protection systems or equipment to be used render previous training obsolete: or (3) Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.    On or about March 24, 2021, and at times prior thereto, employees engaged in applying roofing materials who were exposed to fall hazards need re-training to ensure they understand how to recognize and minimize fall hazards.
