29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated: On or about September 28, 2021, the employer failed to certify that all citations have been abated as well as submit abatement documentation for citations that were issued back in May of 2021. Despite numerous requests, including a Dunning Letter, the employer has failed to respond or submit any abatement for review for: a) Citation 1, Item 1a 29 CFR 1910.1200(e)(1): the employer failed to develop and implement a written Hazard Communication Program. b) Citation 1, Item 1b 29 CFR 1910.1200(h)(1): the employer failed to ensure that employees who work with various chemicals, to include but not limited to, various cans of spray paints, were trained in chemical safety and awareness prior to using the cans of spray paint.

29 CFR 1910.1200(e)(1):Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): On or about March 25, 2021, the employer failed to develop and implement a written Hazard Communication Program that covers the various chemicals being used in the workplace, to include but not limited to, a miscellaneous supply of various cans of spray paint of different colors that are used to mark their various pallets and products.
