(a) Jobsite: On or about March 31, 2021, an employee was working in an approximately nine foot deep excavation that had vertical sidewalls and the employee was not protected from a sidewall cave-in.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) Jobsite: On or about March 311, 2021, the competent person did not prevent an employee from working in an approximately 9 foot deep excavation that was not shored nor sloped. In addition, there were no soil tests done to determine the Class of soil that the employees were working in.
