29 CFR  1926.100(a):  Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Jobsite, 4785 Giese Drive, Pittsburgh, PA 15227:   On or about  October 14, 2021, an employee was working near a trench box as the box was being lifted by an excavator. The employee was not wearing a hard hat.  The employee received a head injury when a part of the trench box fell off and struck the employee on the head.    b) Jobsite, 4785 Giese Drive, Pittsburgh, PA 15227:   On or about  October 13, 2021, an employee who was not wearing a hard hat was working at the bottom of a trench that was approximately 9 feet 8 inches in depth.  The employee was exposed to struck-by hazards from debris falling into the trench from above.    c) Jobsite, 4785 Giese Drive, Pittsburgh, PA 15227:   On or about  October 14, 2021, an employee who was not wearing a hard hat was working at the bottom of a trench that was approximately 9 feet 8 inches in depth.  The employee was exposed to struck-by hazards from debris falling into the trench from above.

29 CFR  1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet (.61m) below the bottom of the members of the support system was allowed when there were indications while the trench was open of a possible loss of soil from behind or below the bottom of the support system:   a) Jobsite, 4785 Giese Drive, Pittsburgh, PA 15227:   On or about  October 13, 2021, an employee was working in a trench that was approximately 9 feet 8 inches in depth with vertical sidewalls.  Speed Shore brand hydraulic shoring with plywood sheeting was being used to shore a portion of the trench near where the ladder was located.  The bottom of the plywood sheeting on the north side of the trench set approximately 3 feet 3 inches above the bottom of the trench making it possible for a loss of soil from behind or below the bottom of the support system.  b) Jobsite, 4785 Giese Drive, Pittsburgh, PA 15227:   On or about  October 14, 2021, an employee was working in a trench that was approximately 9 feet 8 inches in depth with vertical sidewalls.  Speed Shore brand hydraulic shoring with plywood sheeting was being used to shore a portion of the trench near where the ladder was located.  The bottom of the plywood sheeting on the north side of the trench set approximately 3 feet 3 inches above the bottom of the trench making it possible for a loss of soil from behind or below the bottom of the support system.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a) Jobsite, 4785 Giese Drive, Pittsburgh, PA 15227:   On or about  October 13, 2021, employees were working in a trench that was approximately 9 feet 8 inches in depth with vertical sidewalls while not protected from cave-ins.  Employees were exposed to a crushed-by hazard while working in areas of the trench where there was no cave-in protection.  Also, Speed Short brand hydraulic shoring being used to shore part of the trench was not being used in a manner consistent with the manufacturer's tabulated data.     (b) Jobsite, 4785 Giese Drive, Pittsburgh, PA 15227:   On or about  October 14, 2021, employees were working in a trench that was approximately 9 feet 8 inches in depth with vertical sidewalls while not protected from cave-ins.  Employees were exposed to a crushed-by hazard while working in areas of the trench where there was no cave-in protection.  Also, Speed Short brand hydraulic shoring being used to shore part of the trench was not being used in a manner consistent with the manufacturer's tabulated data.    J M Daugherty Industries dba Mister Sewer was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1522776 citation number 1 item number 1a, and was affirmed as a final order on April 26, 2021, with respect to a workplace located at 404 Union Street, Pittsburgh,  PA  15205.

29 CFR  1926.652(c)(2)(iii):  Manufacturer's specifications, recommendations, and limitations, and manufacturer's approval to deviate from the specifications, recommendations, and limitations were not in written form at the jobsite during construction of the protective system:   (a) Jobsite, 4785 Giese Drive, Pittsburgh, PA 15227:  On and before October 14, 2021, a Speed Shore brand hydraulic trench shoring system with plywood sheeting was being used to shore a portion of a trench that was approximately 9 feet 8 inches in depth with vertical sidewalls.  The employer did not maintain a copy of the manufacturer's tabulated data for the shoring system at the jobsite.
