29 CFR 1926.651(e): Employee was not prohibited to be underneath loads handled by lifting or digging equipment: (a) On, or about April 6, 2021, at a job site located West of Sentry Drive on West Sunset Drive, Waukesha, WI, at the East end of the pipeline installation excavation, an employee was exposed to a struck by hazard when working under an excavator bucket being used to add fill dirt on top of a 30 inch pipe that was installed. This fill dirt was being handled by a bucket attached to a Caterpillar 336 excavator, while the bottom man was standing in the section of the trench located below the excavator bucket.

29 CFR 1926.651(k)(2): Where there was evidence of a situation that could result in a possible cave-in or other hazardous condition, the competent person did not remove exposed employees until necessary precautions could be taken to ensure their safety. (a) On or about April 6, 2021, at a job site located West of Sentry Drive on West Sunset Drive, Waukesha, WI, employees were exposed to cave-in and struck-by hazards while conducting pipe installation work in a trench that was not properly protected. The yellow trench box installed at the west end of the trench was placed 2 feet 6 inches above the trench bottom and 2 feet 6 inches below the the top cut of the trench surface. (b) On or about April 6, 2021, at a job site located West of Sentry Drive on West Sunset Drive, Waukesha, WI, spreader bar pins for the four trench boxes in the trench were not installed or fully inserted as required by tabulated data. (c) On or about April 6, 2021, at a job site located West of Sentry Drive on West Sunset Drive, Waukesha, WI, concrete road above and adjacent to the excavation was undermined, and not effectively supported, creating a cave-in hazard and struck by hazard.
