29 CFR 1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  On top of the pneumatic trailer:  On or about April 4, 2021, and at times prior thereto, employees were exposed to a fall hazard greater than four feet when filling trailer tanks with barite on top of a pneumatic trailer.

29 CFR  1910.146(c)(1):The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces:  a) Pneumatic Trailers: On or about April 4, 2021, employees were exposed to atmospheric hazards, while entering the trailer's tanks to retrieve knives or bags that were dropped inside without identifying or evaluating the spaces prior to entry.  b) Pneumatic Trailers: On or about April 4, 2021, employees were exposed to atmospheric hazards, while entering the trailer's tanks to do maintenance operations without identifying or evaluating the spaces prior to entry.

29 CFR  1910.146(c)(4):When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:  Pneumatic tank trailer: On or about April 4, 2021, employees were exposed to atmospheric hazards, while entering the pneumatic tank trailers to perform maintenance tasks. The employer had not developed or implemented a written permit space entry program to address effective procedures and practices to eliminate the presence of recognized hazards in permit-required confined spaces.

On or about April 4, 2021, and at times prior thereto, employees were exposed to struck-by and ejection hazards, when operating a JLG  SKYTRACK 8042 forklift without training in its safe operation.
