29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: a) On or about April 5, 2021, employees were exposed to head injury while working without protective helmets in roofing work areas and below the dumping of roofing debris. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: a) Upper Roof Deck - On or about April 5, 2021, employees were exposed to the hazard of falling approximately 21 feet from the side and rear edges of the roof deck while engaged in roofing activities without the use of fall protection or a safety monitor. b) Lower Roof Deck - On or about April 5, 2021, employees were exposed to the hazard of falling approximately 9 feet from the side and front edges of the roof deck while engaged in roofing activities without the use of fall protection or a safety monitor. Acosta Construction & Design, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13) which was contained in OSHA inspection number 1310876, citation 1, item 2, and was affirmed as a final order on July 10, 2018, with respect to a worksite located at 4110 Vernon Ave., Brookfield, Illinois. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
