29 CFR 1910.106(d)(2)(i): Only approved containers and portable tanks shall be used. Metal containers and portable tanks meeting the requirements of and containing products authorized by chapter I, title 49 of the Code of Federal Regulations (regulations issued by the Hazardous Materials Regulations Board, Department of Transportation), shall be deemed to be acceptable. In the Steel Room, the employer did not ensure that diesel fuel (flammable liquid) was stored in approved containers, exposing employees to fire and burn hazards. Three unapproved collapsible plastic containers were observed storing diesel fuel. The diesel fuel was a classified as a Category 3 flammable liquid according to the safety data sheet.

29 CFR 1910.1200(f)(6): The employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either: The information specified under paragraphs (f)(1)(i) through (v) of this section for labels on shipped containers; or, Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. Inside the Steel Room and Bay 3, employees were using chemicals without the required forms of chemical hazard labeling or markings, exposing employees to chemicals hazards in the following instances: a) At the west end of the Steel Room, three plastic collapsible containers containing diesel fuel b) At the south end of the Steel Room, one oiler containing cutting oil c) At the west end of Bay 3, one 55-gallon steel drum containing cutting oil
