29 CFR  1926.20(b)(2):  The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)  a) Delaware Route 299 and Willow Grove Mill Drive, in Middletown, DE 19709: On or about 4/12/2021; the Employer failed to ensure frequent and regular inspections of the jobsite and equipment were made by a person competent in work zone safety standards which resulted in several hazardous conditions which exposed employees to struck by/caught in hazards when they performed site preparation work for widening/future paving.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to this work environment to control or eliminate any hazard(s) or other exposure to illness or injury:  a) Delaware Route 299 and Willow Grove Mill Drive, in Middletown, DE 19709: On or about 4/12/2021; the employer failed to ensure that employees engaged in trenching and excavation activities were instructed to recognize hazards associated with working in trenches exposing them to a trench collapse while installing a water pipe in a trench measuring approximately 8 feet in depth.  The trench did not have any type of trench box in place to keep the walls of the trench from caving in.  This was at the same time that an excavator was right next to the trench adding vibrations to the area additionally loosening the soil.  Furthermore, without tabulated data no inspections were completed by a competent person prior to requiring employees to work inside the trench.

29 CFR  1926.200(g)(1): Construction areas were not posted with legible traffic signs at points of hazards:  a) Delaware Route 299 and Willow Grove Mill Drive, in Middletown, DE 19709: On or about 4/12/2021; Employees were exposed to multiple hazards onsite including but not limited to struck by/caught in hazards when they performed site preparation work for widening/future paving, when signs were not posted advising that the equipment and personnel were in the roadway effectively closing half the lanes in both the north and south bound directions while employees accessed the work site.

No protective systems were noted in the trench or at the site for use during this excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance paragraph (b) or (c) of 29 CFR 1926.652.  a) Delaware Route 299 and Willow Grove Mill Drive, in Middletown, DE 19709: On or about 4/12/2021; the employer failed to protect employees working in a trench by an adequate protective system.  Employees engaged in trenching and excavating work adding a new sewer line to a new multi-unit development.   The competent person required employees to enter and work in a trench with undermined and unsupported structures, no shields at the ends allowing soil from cracking and fissuring edges continue to breach the work area designated in the trench box and where the trench boxes come together soil was allowed to enter due to the size of the trench boxes not being the same and no type of shielding system was used to prevent the spoil pile from spilling into the work area which was improperly benched and did not have a protective shield in place.
