Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and/or caught-between hazard associated with the operation of  the Kubota Tractor under under varying conditions:    a.  On or about April 1, 2021, Carry-On Trailers, Inc., 637 Shuford Street, Lavonia, GA 30553 (Outside Yard Area) - Employees were exposed to a struck-by and/or caught-between hazard while operating the Kubota Tractor.   The employer did not ensure that exposed employees (Tractor Operators) were trained properly on the safe operation when utilizing the Kubota Tractor according to the Operator's Manual, such as but not limited to:    (a)  Do not operate the tractor or any implement attached to the tractor while under the influence of alcohol, medication, controlled substances, or while being fatigued.   (b) All designated operators shall familiarize themselves with the Operator's Manual before Operating the Tractor.   (c)  All designated operators shall familiarize and understand the hazards associated with the Kubota Tractor and its environmental conditions at the time of use.   (d) Being familiar and using caution when servicing the Kubota Tractor.   Among others, acceptable and feasible methods to abate these hazards would be to provide training and following the mandatory recommendations from the Kubota Tractor Operator's Manual, Section - Safe Operation, page 7.
