29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. Located at 5898 Carbury Way in Westerville, Ohio: On or about April 13, 2021, employees were operating a pneumatic nailer without eye protection, thereby exposed to a struck-by hazard.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   The employer does not protect each employee from the hazard of falling by the us of fall protection systems. This most recently occurred on April 13, 2021, at 5898 Carbury Way in Westerville, Ohio. Employees were setting roof trusses from the top plate of second story walls without fall protection exposed to fall hazards in excess of twenty feet.   A&E Roofing Rubber LLC was previously cited for a willful violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1357646, citation number 2, item number 1 and was affirmed as a final order on 03/22/2019, with respect to a workplace located at 300 Mulberry Avenue, Pomeroy, OH 45769.  Pursuant to 29 C.F.R 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.

29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at 5898 Carbury Way in Westerville, Ohio: On or about April 13, 2021, the employer did not maintain an effective safety and health program to ensure that hazards were identified and corrected onsite while employees performed framing work.   A&E Roofing Rubber LLC was previously cited for a serious violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1) which was contained in OSHA inspection number 1357646, citation number 1, item number 1 and was affirmed as a final order on 03/22/2019, with respect to a workplace located at 300 Mulberry Avenue, Pomeroy, OH 45769.
