29 CFR 1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: A&E Roofing Rubber, LLC at the worksite located at 5123 Secor Rd. (Secor Cedars Apartments) in Toledo, Ohio: On or about May 20, 2021, the employer did not ensure employees were protected head injuries while working below employees performing roofing operations. Employees accessing the ladder and ground at the west side of the structure were exposed to potential impact injuries from falling material. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): A&E Roofing Rubber, LLC at the worksite located at 5123 Secor Rd. (Secor Cedars Apartments) in Toledo, Ohio: On or about May 20, 2021, the employer did not ensure employees were protected from falls of approximately 20 feet while performing roofing operations on a residential structure. A&E Roofing Rubber, LLC was previously cited for a violation of this occupational safety and health standard CFR 1926.501(b)(13), which was contained in OSHA inspection number 1357646, citation number 2, item number 1 and was affirmed as a final order on March 22, 2019, with respect to a workplace located at 300 Mulberry Ave., Pomeroy, OH 45769. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. A&E Roofing Rubber, LLC at the worksite located at 5123 Secor Rd. (Secor Cedars Apartments) in Toledo, Ohio: On or about May 20, 2021, employees were exposed to a 20-ft fall hazard in that an extension ladder, used to access the roof, was used without securing the ladder or extending its side rails at least three feet above the landing surface. A&E Roofing Rubber, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 196.1053(b)(1) which was contained in OSHA inspection number 1357646, citation number 1, item number 3 and was affirmed as a final order on March 22, 2019, with respect to a workplace located at 300 Mulberry Ave., Pomeroy, OH 45769. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
