29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a. On or about April 13, 2021, at the above addressed jobsite, employees performing roofing operations were not provided training on how to minimize fall hazards, thereby exposing employees to the hazards associated with falls.

29 CFR  1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a. On or about November 6, 2020, at the above addressed jobsite, the portable ladder used to access and egress the roof did not extend at least three (3) feet above the upper landing surface, thereby exposing employees to the hazards associated with falls.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a.  On or about April 13, 2021, at the above addressed jobsite, an employee performing residential roofing operations, twelve (12) feet five (5) inches above the ground, was not protected from falls, thereby exposing the employee to fall hazards.  b.  On or about April 13, 2021, at the above addressed jobsite, employees performing residential roofing operations, eleven (11) feet eleven (11) inches above the ground, were not protected from falls, thereby exposing the employees to fall hazards.  Franco Brothers Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1411443, citation number 1, item number 2, and was affirmed as a final order on October 16, 2019, with respect to a workplace located at 2519 Freeland Ct. in Naperville, Illinois.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  a.  On or about April 13, 2021, at the above addressed jobsite, employees had been provided fall protection training, however, the employer failed to keep a written certification record.
