29 CFR  1910.22(a)(2):The floor of each workroom is maintained in a clean and, to the extent feasible, in a dry condition.  When wet processes are used, drainage must be maintained and, to the extent feasible, dry standing places, such as false floors, platforms, and mats must be provided.   On or about April 12, 2021, the employer did not ensure the workroom floor area located across from the dust collector No. 1 and around a 30 amp, 480 volt receptacle was maintained in a dry condition while using an electrically powered mobile welder machine.

29 CFR  1910.254(c)(3)(i):A disconnecting switch or controller shall be provided at or near each welding machine which is not equipped with such a switch or controller mounted as an integral part of the machine. The switch shall be in accordance with Subpart S of this part. Overcurrent protection shall be provided as specified in Subpart S of this part. A disconnect switch with overload protection or equivalent disconnect and protection means, permitted by Subpart S of this part, shall be provided for each outlet intended for connection to a portable welding machine.  On or about April 12, 2021, the employer did not ensure an outlet intended for the connection of a 30 amp, 480 volt Miller, Millermatic 350P portable welding machine was provided with overcurrent protection as specified in 1910, Subpart S.  The overcurrent protection devices being utilized were 150 amp fuses, which were not sufficient protect the 30 amp branch circuit and 30 amp receptacle outlet intended to connect the welding machine.

29 CFR  1910.303(b)(4):Interrupting rating. Equipment intended to interrupt current at fault levels shall have an interrupting rating sufficient for the nominal circuit voltage and the current that is available at the line terminals of the equipment. Equipment intended to interrupt current at other than fault levels shall have an interrupting rating at nominal circuit voltage sufficient for the current that must be interrupted.  On or about April 12, 2021, the employer did not ensure a 30 amp, 480 volt branch circuit and receptacle outlet used to power a 30 amp, 480 volt portable welder machine, was installed with overcurrent protection equipment intended to interrupt current at fault levels sufficient for the nominal circuit voltage at fault levels.   The overcurrent protective devices being utilized were 150 amp fuses, which were not sufficient to protect the 30 amp branch circuit, receptacle outlet, and portable welder machine.

On or about April 12, 2021, the employer did not ensure the conductors of a 30 amp, 480 volt branch circuit and receptacle outlet used to power a 30 amp, 480 volt potable welder machine, were protected from overcurrent in accordance with their ability to safety conduct current.  The overcurrent protective devices being utilized were 150 amp fuses, which were not sufficient to protect the 30 amp branch circuit, 30 amp receptacle outlet, and 30 amp portable welder machine.

29 CFR  1910.254(d)(9)(i):The operator should report any equipment defect or safety hazard to his supervisor and the use of the equipment shall be discontinued until its safety has been assured. Repairs shall be made only by qualified personnel.  On or about April 12, 2021, the employer did not ensure a Miller, Millermatic 350P portable welder machine, with a damaged and spliced flexible electrical power cable was discontinued from use until the power cable was repaired by a qualified person and safety assured.

Joining lengths of work and electrode cables shall be done by the use of connecting means specifically intended for the purpose. The connecting means shall have insulation adequate for the service conditions.   On or about April 12, 2021, the employer did not ensure the damaged insulation and exposed bare conductors of a Miller, Millermatic 350P MIG welder machine's flexible electrical power cable were replaced or the power cable's joining lengths of cable were connected by a means specifically intended for that purpose.  The employer failed to ensure the power cable had insulation adequate for the service conditions.

29 CFR  1910.303(c)(3)(i):Conductors shall be spliced or joined with splicing devices identified for the use or by brazing, welding, or soldering with a fusible metal or alloy. Soldered splices shall first be spliced or joined to be mechanically and electrically secure without solder and then soldered. All splices and joints and the free ends of conductors shall be covered with an insulation equivalent to that of the conductors or with an insulating device identified for the purpose.  On or about April 12, 2021, the employer did not ensure the conductors of a Miller, Millermatic 350P portable welder machine's electrical power cable were spliced and jointed with solder and covered with an insulation equivalent to that of the conductors or the cable.

29 CFR  1910.334(a)(2)(i):Portable cord and plug connected equipment and flexible cord sets (extension cords) shall be visually inspected before use on any shift for external defects (such as loose parts, deformed and missing pins, or damage to outer jacket or insulation) and for evidence of possible internal damage (such as pinched or crushed outer jacket). Cord and plug connected equipment and flexible cord sets (extension cords) which remain connected once they are put in place and are not exposed to damage need not be visually inspected until they are relocated.  On or about April 12, 2021, the employer did not ensure the flexible electrical power cable (cord) of a Miller, Millermatic 350P portable welder machine, was inspected for external defects or damage to the insulation or evidence of internal damage to the cable before it was used.  The flexible electrical power cable had damaged outer insulation, damaged insulation on the internal conductors, and multiple improperly spliced joints along the length of the cable.
